These Terms of Use ("Terms") govern your access to and use of the PermitPath mobile application and related services (collectively, "the App"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.
These Terms are provided for general informational purposes and do not constitute legal advice. Your use of the App does not create any attorney–client relationship between you and PermitPath. If you have questions about your legal rights or obligations, you should consult with a qualified attorney in your jurisdiction.
Your use of the App constitutes your acceptance of and agreement to these Terms, including any additional terms and policies referenced in or incorporated by these Terms (such as our Privacy Policy). If you use the App on behalf of a company or organization, you represent that you are authorized to bind that entity, and "you" includes both you as an individual and that entity.
Subject to your ongoing compliance with these Terms, PermitPath grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a compatible mobile device that you own or control for your own internal business or personal use. We reserve all rights in and to the App not expressly granted to you under these Terms.
You are solely responsible for how you use the App and for verifying all routes, permits, regulations, road conditions, restrictions, and legal requirements before and during travel. The App is a routing tool and is not a substitute for your professional judgment or for reviewing official permit documents, traffic control devices, and applicable laws.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERMIT PATH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.
Without limiting the foregoing, we do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PERMIT PATH AND ITS OWNERS, DEVELOPERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In any case, our total aggregate liability arising out of or relating to the App will not exceed the amount you paid (if any) to purchase or use the App in the twelve (12) months preceding the claim.
The App is a planning tool and should be used as one of several resources when planning and executing oversize and permit-based routes. Routes, waypoints, and navigation instructions may be incomplete, inaccurate, or outdated, and may not reflect current road conditions, closures, detours, construction, height or weight restrictions, or permit requirements.
YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ALL ROUTES, PERMITS, RESTRICTIONS, AND ROAD CONDITIONS BEFORE AND DURING TRAVEL. YOU MUST NOT RELY SOLELY ON THE APP WHEN SAFETY, LEGAL COMPLIANCE, OR PERMIT COMPLIANCE ARE AT STAKE.
The App may use or rely on third-party services, such as mapping providers, app stores, or operating system services. We do not control these third-party services and are not responsible for their availability, accuracy, or performance. Your use of third-party services may be subject to the separate terms and privacy policies of those third parties.
You agree to indemnify, defend, and hold harmless PermitPath and its owners, developers, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
The App and all associated content, features, functionality, trademarks, service marks, and logos are owned by or licensed to PermitPath and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App except as expressly permitted by these Terms or with our prior written consent.
We may modify, suspend, or discontinue any part of the App at any time, with or without notice. We may also update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws that apply in the jurisdiction where PermitPath is organized or primarily operates, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the App will be brought exclusively in the courts located in that jurisdiction, and you consent to the personal jurisdiction and venue of those courts.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Certain features of the App may be offered as in-app purchases or auto-renewing subscriptions (for example, a monthly subscription). Prices, terms of access, and available products are displayed within the App and may vary by region, currency, or platform. All purchases and subscriptions are processed by Apple (App Store) or Google (Google Play), and your billing relationship is primarily with those platforms.
By starting a subscription, you authorize Apple or Google to charge the subscription fee (and any applicable taxes) to the payment method associated with your account, in accordance with their terms. Subscriptions may automatically renew at the then-current price and billing period unless you cancel before the end of the current period. You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings.
We do not control, and are not responsible for, how Apple or Google handles billing, refunds, or disputes. Any refund requests must be submitted directly to Apple or Google, and will be handled under their respective policies and applicable law.
